Having said the above, we can pass on to you that at the present time, because of the lack of legal protection in terms of discoverability issues if the JCAHO has even temporary access to any data or documents from an root cause analysis conducted in response to a sentinel event, it would seem very risky to allow any such access. Therefore, it seems to us to be far safer to request a thorough review by the JCAHO of your root cause analysis processes, this being the fourth reporting option.
